Adknowledge Rewards Sweepstakes Terms and Conditions of Entry
To be an eligible entrant for the Adknowledge Rewards Sweepstakes, you must review and agree to abide by and be bound by the below terms and conditions. Your submission of an entry form to participate in the Adknowledge Sweepstakes serves as your assent to these terms and conditions; if you do not agree to any term or condition, you may not enter the Sweepstakes.
1. No purchase is necessary to enter or win the Adknowledge Rewards Sweepstakes (the "Sweepstakes"). The Sweepstakes is void where prohibited by law and is subject to applicable federal, state and local law. The Sweepstakes is sponsored by Adknowledge, Inc. ("Sponsor"). The Sweepstakes begins at 12:00 a.m. (CST) on January 1, 2008 and ends at 11:59 p.m. (CST) on December 31, 2008 (the "Entry Period").
2. Eligibility. Entrants must be 18 years of age or older and must agree to these terms and conditions. Entries will not be intentionally accepted from individuals under the age of 18, and any such entries are void. The Sweepstakes is offered only in the United States of America. Persons who are not US residents are not eligible to participate in this Sweepstakes, and any entries by such persons are void. Persons who are employees, officers, directors, agents or representatives of Sponsor, participating retailers, their respective parent corporations, affiliates, subsidiaries, advertising and promotion agencies, suppliers, distributors, and members of the immediate family (defined as mother, father, sister, brother, daughter, son or spouse, regardless of where they live), and those living in the same household of each (whether related or not), are not eligible to enter. Limit of one entry per person, per household, per email address. If multiple entries are received for a yearly drawing, only the first entry will be considered and all subsequent entries will be void. Limit of one winner per person, household, immediate family or address (street or email).
3. How to Enter. Complete and submit the online entry form offered by a participating provider, including email address. To be valid, entries must be submitted through a bona fide entry form. You may also send a 3x5 card addressed to Adknowledge Rewards Sweepstakes, Attn: Legal, 4600 Madison, 10th Floor, Kansas City, Missouri 64112; the 3x5 card must state “Sweepstakes Entry” on it along with your email address, and it must bear a post-mark issued by the United States Post Office. Any other attempted entries are void. Any entry form containing incomplete, incorrect, or unintelligible information is void. Sponsor is not responsible for late, lost, damaged, or misdirected entries. BY ENTERING THIS SWEEPSTAKES, ENTRANTS MUST AGREE (1) TO BE BOUND BY THESE SWEEPSTAKES RULES, (2) THAT THEY HAVE READ AND UNDERSTAND THE TERMS OF THE ADKNOWLEDGE PRIVACY POLICY, POSTED AT PRIVACY.ADKNOWLEDGE.COM, WHICH APPLY TO THIS SWEEPSTAKES, (3) TO HOLD SPONSOR HARMLESS FROM AND AGAINST ANY CLAIMS OR LIABILITIES ARISING DIRECTLY OR INDIRECTLY FROM THIS SWEEPSTAKES. Any entry form received after the current Entry Period may be entered in the prize drawing for a subsequent Sweepstakes, if offered. Any data submitted to Sponsor pursuant to entering this Sweepstakes becomes the property of Sponsor and may be used for any legal purpose including conducting email marketing.
4. Drawing. All eligible entry forms received during the current Sweepstakes will be entered into a random drawing to be held during the first thirty (30) days after the current Sweepstakes ends or as soon thereafter as practicable. Potential prize winners may be notified by email at the email address provided on the entry form, or by other means, depending upon the contact information provided by the entrant. Odds of winning are determined by the total number of valid, timely, and eligible entry forms received during the Entry Period.
5. Prize. One (1) prize will be awarded per Sweepstakes. The Sweepstakes prize is a check for ONE THOUSAND DOLLARS made out in the name of the winning entrant. All values are stated in United States dollars. Prizes cannot be substituted, assigned or transferred by winners prior to award. Sponsor reserves the right, at its sole discretion, to substitute a prize of equal or greater value should featured prize become unavailable for any reason.
6. Prize claim. The Sweepstakes winner will be notified by email or other means within five business days of the Sweepstakes drawing in which the winning entry was selected. Prizes are non-transferable. Prizes not claimed by the winner(s) promptly after notification from the Sponsor will be forfeited. Sponsor reserves the right to require each winner to provide identification, to prove eligibility, and to return a signed and notarized Affidavit of Eligibility and Release of Liability Form (the "Eligibility Form") in order to claim a prize. The Eligibility Form certifies eligibility and compliance with these Official Rules and serves to release and to hold harmless Sponsor, and its affiliates, subsidiaries, advertisers, and agencies from and against any liability arising out of this Sweepstakes. Failure to timely return the Eligibility Form will result in forfeiture of the prize. A prize notification returned as undeliverable will result in forfeiture of the prize. The prize winner is responsible for all applicable taxes. All prize winners and prizes will be reported to governmental tax authorities as required by law.
7. General rules. General rules. Sponsor is not responsible or liable for lost, late, incomplete or misdirected entries; or for any computer, telephone, Internet, cable, network, electronic or other hardware or software malfunctions, failures, connections, availability or garbled transmissions, or Internet accessibility or availability, traffic congestion, or unauthorized human intervention. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes or web site; who is entering the Sweepstakes for any reason other than a bona fide intent to enter and try to win; or to be acting in violation of these Official Rules. Any use of robotic, automatic, macro, programmed or similar entry methods will void all entries by such methods. By submitting an entry for this Sweepstakes, you agree to abide by these rules and any decision Adknowledge makes regarding this Sweepstakes, which are final and binding in all respects; generally, in the event of dispute about the identity of a prize winner, the winning entry will be deemed made by the Account Holder of the email address submitted at the time of entry. "Account Holder" means the natural person who is listed as the owner of an email address by an Internet service provider or other organization that is responsible for assigning email addresses. Whether an entrant is eligible is solely within the discretion of Adknowledge. A potential winner may be required to provide Sponsor with proof that he or she is the account holder of the email address associated with the potential winning entry. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering or unauthorized access, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction or unauthorized access to the web site. Sponsor is not responsible for injury or damage to entrants or to any other person's computer related to or resulting from participating in this Sweepstakes. IF, FOR ANY REASON, THE SWEEPSTAKES IS NOT CAPABLE OF RUNNING AS PLANNED (FOR EXAMPLE BUT NOT BY WAY OF LIMITATION, BY REASON OF INFECTION BY COMPUTER VIRUS, WORMS, BUGS, TAMPERING, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR ANY OTHER CAUSES WHICH COULD CORRUPT OR AFFECT THE ADMINISTRATION, SECURITY, FAIRNESS, INTEGRITY OR PROPER CONDUCT OF THIS SWEEPSTAKES), SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THIS SWEEPSTAKES AT ANY TIME. All federal, state and local taxes are the sole responsibility of the winner. Sponsor reserves the right to disqualify entrants who fail to follow these Official Rules, applicable laws and regulations or who make any misrepresentations relative to the Sweepstakes, their entries, and claiming of a prize. Entry constitutes permission to use winners' names, addresses, photographs, video footage and/or voice recordings for publicity purposes (including posting on-line) without additional compensation or permission except where prohibited by law. Sponsor and its affiliates, subsidiaries, agencies and each of their respective officers, directors, employees, agents, successors and assigns are not responsible for any negligence, claims, liability, injury, property loss or other damages of or to participants and/or the winner arising from, or in connection with this Sweepstakes. This Sweepstakes is subject to applicable federal, state and local laws and regulations.
8. Conditions. Upon delivery of a prize to a winner, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full ownership and responsibility for the prize. CAUTION: Any attempt made by an entrant to deliberately damage Sponsor's web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, or if the Sponsor suspects that there has been any electronic tampering or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right to seek damages from any such entrant as permitted by law and to void such participant's entries from the Sweepstakes. THIS SWEEPSTAKES IS SOLELY AND EXCLUSIVELY GOVERNED BY THE LAWS OF THE STATE OF MISSOURI AS APPLICABLE TO CONTRACTS MADE AND PERFORMED WHOLLY THEREIN. ANY ACTION, PROCEEDING OR LITIGATION RELATING TO THIS SWEEPSTAKES MUST BE INSTITUTED AND PROSECUTED SOLELY AND EXCLUSIVELY WITHIN A STATE OR FEDERAL COURT LOCATED IN THE STATE OF MISSOURI, JACKSON COUNTY, KANSAS CITY.
9. Winners list. For names of Sweepstakes winners or for questions about this Sweepstakes, send a self addressed stamped envelope to Adknowledge Rewards Sweepstakes, Attn: Legal, 4600 Madison, 10th Floor, Kansas City, Missouri 64112 with your question or specifying your request to receive a complete list of winners.
